Police: Point Marion man shot wife and blamed her son

A Point Marion man allegedly shot his wife after she pulled him off her son during a fight, then blamed the son for the shooting.

State police issued an arrest warrant for James Daniel Whoolery, 37, on Thursday.

Kelly Irene Whoolery was transported to Ruby Memorial Hospital in Morgantown, West Virginia for a gunshot wound to the abdomen. Police said the bullet hit her liver and spleen.

According to the affidavit of probable cause, she told police that she was arguing with her son, Garrett Weeder Jr., and his girlfriend in a camper at 300 New Geneva Road in Springhill Township shortly after midnight.

She said her husband came into the camper and began punching Weeder. Police said Weeder had cuts on his face.

The woman said she was eventually able to pull her husband off of her son, and he left. A few minutes later, she said she heard more than five shots fired from behind the camper and immediately felt a gunshot to her abdomen. She fell to the floor and waited for help, the affidavit said.

Weeder said he began screaming that his mom had been shot. He said Whoolery went into the camper, looked at the woman and called 911 saying, “There has been a shooting. Wife is shot,” according to court documents.

Weeder said he believes Whoolery left a .22-caliber magazine on the counter of the camper.

Weeder told police Whoolery looked at him and said, “This is your fault,” then fled the scene.

Police said Whoolery was not permitted to own a firearm because he was convicted of aggravated assault in 2000.

Police listed multiple shell casings and a box for a .22-caliber long rifle found while conducting a search warrant on the camper and neighboring mobile home, but they did not say the the rifle was found.

Whoolery is charged with three counts each of attempted homicide, aggravated assault and reckless endangerment and one count each of prohibited possession of a firearm, simple assault and discharge of a firearm into an occupied structure.
