Charges waived in Lafayette American Legion arson
A former LaFayette American Legion bartender waived his charges Wednesday for allegedly burning Post 51 in South Union Township, which was home to 423 veteran members.Â
James Vernon Shaffer Jr., 38, of Fairchance accepted a tentative plea deal of 4 to 8 years in prison followed by one year probation, according to Fayette County District Attorney Rich Bower. He will also be required to pay $900,000 in restitution to the postÄ¢¹½ÊÓÆµ insurance company, which is covering the cost of damages.
Shaffer was a bartender for about six months and a social member, meaning he was not a military veteran. He allegedly stole $2,000 from the bar June 1 after the last patron left, then took newspapers and started a fire in the kitchen. Surveillance video caught his actions at the post, according to court documents.
Bower said the American Legion commander, Robert Doria, agreed to the tentative offer. The postÄ¢¹½ÊÓÆµ new roof was just completed, he said.
Doria said in a previous interview the postÄ¢¹½ÊÓÆµ veterans were devastated by the loss, but continue to move forward with plans to rebuild – with improvements. He said they plan to put a gym in the basement to attract younger veterans and add a porch.
The post is continuing with its scheduled programs while members work from their desks in their homes.
Doria described the post as a home to veterans and each of its members as family.
Shaffer is facing four felony charges – two counts of arson and one count each of criminal mischief and theft. He is lodged in Fayette County Prison in lieu of a $200,000 bond. He is represented by Attorney John A. Kopas III.
Shaffer was scheduled for a fast-track plea at 1:30 Sept. 12.
