Man convicted of trespass in Pershing Court robbery death charged with escape
A man who was sentenced to house arrest in connection with a drug robbery leading to a fatal shooting is facing a new charge of escape.
An arrest warrant was issued Tuesday for Devin Michael Fitzgerald, 29, of West Askren Street in Uniontown after an adult probation officer reported he has not had contact with Fitzgerald for months.
Fitzgerald was convicted of criminal trespass March 1 and sentenced to 24 months of intermediate punishment with 18 months on house arrest with electronic monitoring, according to court documents.
Fitzgerald was charged along with four others in the death of Marquell L. Bailey, 25, of Cleveland, Ohio. Fitzgerald, Bailey, Megan Marie Bowlen, 25, Joel Grooms, 30 and Miranda Jean Engle, 31, allegedly planned to rob Derek Lee Royster, 29, of drugs at a vacant Pershing Court Apartment Nov. 27. Royster allegedly shot Bailey, who died.
According to the affidavit of probable cause filed in FitzgeraldÄ¢¹½ÊÓÆµ case, his electronic monitoring device had been inactive since July 18.
Probation officers reported to his home July 20, and were told Fitzgerald left that morning.
The tracking device could not be found at the house.
He was charged by Uniontown City Police with escape and theft.
